General Terms and Conditions

1. Scope

These terms apply to all orders placed in the E-CarFit online shop (ecarfit.com). Your contractual partner is E-CarFit, owner Lukas Jaksch, Tiergartenstraße 17/2, 2381 Laab im Walde, Austria, email: office@ecarfit.com. Deviating terms of the customer only apply if we have expressly agreed to them. If the customer is a consumer, mandatory consumer protection provisions remain unaffected.

2. Conclusion of the contract

The presentation of products in the online shop is not a legally binding offer but an invitation to order. By clicking the order button at the end of the checkout you submit a binding offer to buy the goods in your cart. You can check and correct your details at any time before submitting. We confirm receipt of your order by email. The contract is concluded with our shipping confirmation or the delivery of the goods.

The contract language is German; in the English section of the shop also English. We store the contract text; you receive the order details by email.

3. Fitment

Our products are assigned to specific vehicle models, model years and, where stated, drive types and steering side. Please check these details on the product page before ordering. If in doubt, we are happy to advise you in advance. Vehicle manufacturer brand names are used only to describe the fitment; we are not affiliated with the manufacturers.

4. Prices and shipping costs

All prices are final prices in euros. As a small business under § 6 (1) 27 of the Austrian VAT Act (UStG), we do not charge VAT. Shipping costs are shown separately in the cart and at checkout before you place your order. For deliveries to countries outside the EU, customs duties, taxes or fees may apply, which are borne by the customer.

5. Payment

The available payment methods are shown at checkout. Payment is processed by Shopify's payment service or the payment provider you choose.

6. Delivery

We deliver to the address given at checkout in the countries selectable there. The expected delivery time is stated on our "Shipping & Delivery" page or at checkout. Orders may ship from different warehouses; partial deliveries are possible but cause no additional shipping costs for you. You receive a tracking number as soon as your order has shipped.

7. Retention of title

The goods remain our property until paid in full.

8. Right of withdrawal

Consumers have a statutory right of withdrawal of 14 days. Details can be found in our withdrawal policy. You can also declare your withdrawal online via "Withdraw from contract".

9. Warranty

The statutory warranty under the Austrian Consumer Warranty Act (VGG) and the Austrian Civil Code (ABGB) applies. The warranty period for goods is two years from delivery. Please report defects or transport damage to our email address as soon as possible so that we can take care of it quickly; your statutory rights remain unaffected.

10. Liability

We are only liable for damages caused intentionally or by gross negligence. This does not apply to personal injury or claims under the Product Liability Act; towards consumers the limitations only apply as far as legally permitted.

11. Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. If you have questions or problems, please contact us directly – we are happy to find a solution.

12. Applicable law and place of jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Towards consumers this choice of law only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence. For consumers resident in Austria, the statutory place of jurisdiction applies.
